Privacy Policy

In line with the new GDPR (General Date Protection Regulation) coming into force as of May 25th 2018, I want to make sure you fully understand how I, as a sole trader, collect, use and protect your data, as clearly as possible:-

What information is being collected, and how?

IP addresses
I use Google Analytics to show how many people visit my site and when. it helps me to find out which content is relevant to my customers, and to make the site as user friendly as possible. To track this information, Google uses your IP address to identify you as a visitor - it is not used to discover any further information about you.

Name, email address, phone number
If you complete a commission contact form on my website, I receive that information via my business email address '[email protected]', where it may be stored in my inbox. This information will only be used to respond/follow up to your enquiry. You will be asked if you would like to receive our newsletter containing offers, new and events when I respond, and sent a link to complete the newsletter sign up, and indicate your acceptance of my GDPR compliance statement.

If you opt-in to receive email newsletters, your data will be stored with our email marketing provider, MAILCHIMP. You can view their privacy policy here:-

MAILCHIMP PRIVACY POLICY

Purchases via my online shop are processed by the eCommerce provider ECWID, and payments are processed by payment gateways STRIPE or PAYPAL. When you make a purchase, I receive your name, email address and telephone number. I DO NOT receive payment details such as bank account details or credit card/debit card numbers - these are hidden from my view, and stored subject to the payment processors terms & conditions, which can be found here:-

I receive your name, address, telephone and email address via my business email [email protected] following your transaction to allow me to fulfil the order.

In the rare event that payment details are taken via telephone, your financial information will be held securely for 24 hours and then destroyed.

Finally, we may collect your name, email and/or address at trade shows such as Your Horse Live, The Great Yorkshire Show and Countryfile Live with regards to artwork commission enquiries - in this case you will be asked to complete an enquiry card, on which you will be able to opt-in to receive email news and offers. If you opt in, your information will be transferred to my email marketing provider, MAILCHIMP. If you choose not to opt in to email marketing, the information will be used to reply to your initial enquiry only.

Hard copies of data collected at tradeshows is destroyed once either transferred to MAILCHIMP (opt-ins) or used to reply to your initial enquiry.

Why is it being collected, and how will it be used?

We require your data to:-

Fulfil online orders;
Send you my newsletter containing news, offers and events (if you have opted in to receive these emails);
Respond to enquiries from you effectively;
Ensure my website is providing relevant information and functioning to my customers liking.

Will we share your data?

I never sell or otherwise abuse your personal information. As detailed above, your information is shared (through necessity to provide my services) securely with:-
ECWID, and PAYPAL or STRIPE for online order fulfilment
GOOGLE (IP address only)

What does this mean for you?

If you have opted in to receive emails from me, you will receive infrequent emails (once a month approximately) which will contain information about recently competed commissions, new releases, upcoming shows/events, and discounts and special offers available through my online shop.

If you have made an enquiry at a trade show or via my online contact form / email address, you will receive ONLY correspondence relating to your enquiry.

If you no longer wish to receive emails, it is very easy to unsubscribe using the unsubscribe link at the bottom of any email newsletter. You will receive no further emails from me. You can also email [email protected] FROM the email address you wish to unsubscribe, and I will manually remove you within 48 hours from my database.

Terms & Conditions 

Gift Vouchers

• Gift Vouchers cannot be exchanged for cash and are valid for three years from the date purchased (visible in the unique voucher code).
• Vouchers may be used as full or part payment against any gift shop item unless stated otherwise in the item description.
• Your shopping bag total must be equal to or greater than the value of the voucher. 
• Vouchers may be used as part payment towards a pet portrait. 
• Only one voucher may be used per order via the online gift shop.
• Multiple vouchers may be used in payment towards a pet portrait.
• Each voucher shows a unique discount code, that may only be used once. It is your responsibility to safeguard this code for your personal use. Once a voucher code has been used online, it will no longer be valid.
• Refunds are not available on goods purchased with vouchers, and in the event that you are unhappy with goods purchased, a credit note will be issued upon return of the item. This does not affect your statutory rights. 
• Gift vouchers are non-refundable.

• Copyright on all the artwork produced is retained by myself, Katie Hough. This includes the right to use images of the artwork in promotional materials. 
• Customer emails, in whole or in part, may be used as testimonials online and in print. If you would prefer these not to be used please let me know when ordering.
• All website content is the property of Tom Helme (Local Creative and Katie Hough). Images and text may not be used without prior permission, and any person found to be using images and text without aforementioned permission may be subject to legal proceedings.

Returns Policy

We are committed to quality and your satisfaction is 100% guaranteed.

Incorrect or Damaged Goods 
If we shipped you the wrong item or your item arrives damaged or in poor condition, simply email us a digital photo of the damaged or incorrect item and the shipping container to [email protected]. Please include in the body of the email: your order number, the shipping ID or item number, a brief description of the reason for the return, and tell us whether you are seeking a replacement or a refund. Please send your request within 30 days of receipt. Your request will be processed within 48 hours and you will receive an email letting you know your replacement is under production or your refund is being processed. If you select a refund, you will be refunded the full cost of the item and the cost of delivery

Other Returns:
If your items arrived in good condition but you have changed your mind, no problem! You can return your item within 30 days of receipt and receive a refund for the price of the product.

If you notify us of your intent to return your item within 14 days of receiving it, you may also be entitled to a refund of the cost of delivery. Cost of delivery is the amount paid by you for shipment of the goods to your designated shipping address (with the exception of the supplementary costs resulting from your choice of a non-standard delivery method). We do not refund the cost of delivery for serviced items, all of which are custom-made to order. Serviced items include all framed items, canvas. To qualify for a refund of the cost of delivery (if applicable), you must return the goods within 14 days of your request of a refund.

To return an item, please pack them in the original box  You may also inform us of your intent to return an item via letter by post or e-mail. Please include your name, postal address, email address, telephone numbers, as well as your order number, the shipping ID and/or item number. Please include a brief description of the reason for the return.

Please be aware that you are obligated to bear the direct cost of returning the goods. We strongly encourage you to return your item via a trackable method. If you are returning an item that is not normally capable of being returned by post, you are still responsible for the cost of returning the item.

Refund Payments
Refunds will be issued by the same means of payment as you used for the initial transaction. You will not incur any fees as a result of such refund. We withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

Exchanges
If your item arrived in good condition, but you would like to exchange it for a product in a different size or for a different item, please return the item for a refund using the method described in "Other Returns" and place a new order.
